Copyright Policy

This document explains our policy regarding copyright; it outlines guidelines and rules related to the use, protection and management of copyrighted materials. By becoming a Developer on our Services, everything mentioned hereafter applies to you.
1. Definitions
1.1. "User" means a person or entity that is registered with Pokéngine to use our Services.
1.2. "User Content" and "Content" mean content created or generated by a user.
1.3. "Services" means any service, app, website or product provided by Pokéngine pursuant to our Terms of Service ("ToS").
1.4. "We", "us" and "our" refer to Pokéngine.
1.5. "You," "your" and "yours" refer to you, the user.
2. What is copyright?
2.1. Copyright is a legal right that grants the creator of an original work exclusive control over its use and distribution, prohibiting others from reproducing, distributing, or displaying the work without permission. This protection generally extends for a specified period, after which the work enters the public domain.
3. Copyright infringement
3.1. Copyright infringement occurs when someone violates the exclusive rights of a copyright holder without permission. This includes unauthorized reproduction, distribution, display, or adaptation of copyrighted material, infringing on the rights granted to the original creator or owner. Examples of copyright infringement can include:
  • copying and distributing a book, song, or artwork without permission from the copyright owner;
  • presenting someone else's written work, ideas, or creative content as your own without proper attribution or permission;
  • creating a derivative work, such as a movie or play, based on a copyrighted book or script without obtaining the necessary rights; and
  • illegally downloading or distributing copyrighted movies, music, software, or other digital content without the consent of the copyright owner.
3.2. Any copyright owner, adhering to the procedures outlined in this Copyright Policy, can request us to remove their copyrighted content uploaded by a user of our Services. Upon receiving a proper notice and becoming aware that content on Pokéngine infringes upon the copyrights of another user, creative individual or company, we will immediately delete the content. Compliance with this legal requirement is immediate; no advance warning or opportunity for correction will be provided.
If you believe that Content on our Services infringes upon your copyright, you can report it by contacting us. Our staff will thoroughly review your notice and take appropriate action.
3.3. By uploading your Content to our Services, you acknowledge that said Content does not infringe upon any third-party copyright, trademark, or proprietary rights. You also agree to indemnify us against any loss or damage resulting from potential infringements of third-party intellectual property rights.
Repeated uploading of infringing content will result in the suspension of your account, and serious offenders may have their account permanently banned. We view three strikes as evidence of being a repeat infringer, warranting a ban. Deliberate misrepresentation of another's copyrighted work as your own will lead to the immediate deactivation of your account.
If you infringe the copyright of a content owner by posting material on our Services, the copyright owner may choose to initiate direct legal action against you.
4. User copyrights
4.1. When you upload any Content to our Services, you inherently gain copyright ownership over your creative works. This means that you have exclusive rights to control the reproduction, distribution, display, and adaptation of your Content. This copyright protection is automatically granted to you as soon as the Content is uploaded. Importantly, this ownership extends as long as the user's work does not infringe upon the copyrights of third-parties. In respecting the rights of others, users can enjoy the benefits of their own creative expression within the bounds of copyright law.
